Mr. McKiernan is an experenced maritime attorney, and is one of only approximately nine proctor members of the Maritime Law Association in Rhode Island.  He has handled cases involving death on the high seas, cargo claims, technical specifications of yachts, collision, salvage, and maritime insurance coverage issues. He has presented seminars relating to Maritime torts to the members of the Rhode Island Bar.

A former licensed commercial shell fisherman, known locally as a “quahogger”, Mr. McKiernan has parlayed his knowledge of boating and the local waters into a subspecialty in maritime cases.  Mr. McKiernan is accepting consultations in the area of maritime law by members of the maritime insurance industry, small business persons involved in maritime trade, individuals with questions relating to their own vessels, DEM issues or citations.

Example cases:

Salvage. Numerous salvage cases on behalf of small businesses and insurance carriers. Cases include private yachts as well as specialized commercial seagoing equipment. Value of cases has ranged from $5,000 to $1 million.

Cargo Loss. Cargo lost from sealed containers prior to final delivery. Value of loss $300,000.

Collision. Mr. McKiernan has handled numerous maritime collision cases involving property damage, personal injury, as well as Coast Guard and/or DEM involvement. Values have ranged from $5,000 to $300,000.

Death on High Seas. Co-counsel on DOHSA case involving sudden sinking of large sailing vessel with numerous fatalities.

Yacht Specifications and Repair. Represented purchaser of $900,000 yacht in claim against manufacturer for failure to meet specifications and/or effect appropriate repairs.
